2. Software Licensing

License Grant

Subject to your compliance with these Terms, BluePeak Studios LLC grants you a limited, non-exclusive, non-transferable, revocable license to use our software for your personal or internal business purposes.

License Types

  • Personal License: For individual, non-commercial use on a single device
  • Family License: For use by immediate family members on up to 5 devices
  • Business License: For commercial use within a single organization
  • Enterprise License: Custom licensing for large organizations (contact sales)

License Restrictions

You may NOT:

  • Reverse engineer, decompile, or disassemble the software
  • Remove or modify any copyright, trademark, or proprietary notices
  • Distribute, sublicense, or transfer the software to third parties
  • Use the software for illegal or unauthorized purposes
  • Circumvent any technological protection measures

3. Code Signing and Security

All BluePeak Studios software is digitally signed with certificates from SSL.com. This ensures:

  • Authenticity of the software publisher
  • Integrity of the software (no tampering)
  • Protection against malware and unauthorized modifications

Always verify the digital signature before installing our software. Authentic BluePeak Studios software will display "BluePeak Studios LLC" as the verified publisher.

4. Purchases and Payments

Pricing

All prices are listed in USD and are subject to change without notice. We reserve the right to modify pricing at any time.

Payment Processing

Payments are processed through secure third-party payment providers. We do not store your complete credit card information.

Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, contact us within 30 days for a full refund. Refunds are processed within 7-10 business days.

Subscription Services

Some products may require recurring subscriptions. You will be charged automatically unless you cancel before the renewal date. You may cancel at any time through your account settings.

5. Updates and Support

Software Updates

Your license includes free updates for one year from the date of purchase. After one year, you may continue using your current version or purchase an update subscription.

6. User Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Ensuring your use complies with applicable laws and regulations
  • Maintaining adequate backups of your data

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEPEAK STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:

  • Your right to use the software ceases immediately
  • You must destroy all copies of the software in your possession
  • Refunds will not be provided for terminated licenses due to breach

11. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use or export the software in violation of U.S. export laws or regulations.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where BluePeak Studios LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our website. Your continued use of the software after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
